Letter to the editor: Bad referendum

Our rules and laws are supposed to protect us, help our society run more smoothly, and meet the needs of all people. Sometimes, these laws need revising to ensure they are for the good of all, so our lawmakers write amendments and referendums. In other cases, however, those in power disregard important safeguards and even write amendments that purposely and egregiously aim to restrict people’s rights.

This November, a group of ill-intentioned legislators are proposing an amendment that on the surface looks equitable, but that in reality is the opposite. Section 27, article 1 of the Wisconsin Constitution proposes to prohibit the state from serving all its people fairly. The amendment’s language, which is purposely confusing and deceptive, asks voters this question: 

“Shall section 27 of article 1 of the constitution be created to prohibit governmental entities in the state from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in public employment, public education public contracting, or public administration?” 

Asking Wisconsinites to vote “yes” to the amendment is grossly misleading because it will actually negate already established equity-based programs that encourage fair treatment under the law for many Wisconsin residents. It will further eliminate the equity gains Wisconsin has made over the past 50 years for women and minorities.

Federal law already mandates that governmental discrimination is unconstitutional. Thus, while some lawmakers are framing the referendum as promoting equality and fairness, in reality, it would reduce Wisconsin’s capacity to address long-standing disparities. Worse, it would strip public systems of tools essential for promoting equal opportunity and equitable access to the underserved and vulnerable in our society in such areas as: health equity; education; community-action programs; business/employment; state contracts, and the ADRC.

Don’t be fooled. Spread the word about the deceitful referendum and encourage people to vote NO for all three of the Wisconsin Constitutional Amendments on Nov. 3.
