A Menomonie decided to take a nap in the middle of a rural intersection after an alleged night of drinking last week.
Eric Carson Schultz, 33, Menomonie, was ordered to pay $2,000 cash bond June 27 in Pierce County Circuit Court on felony OWI fifth/sixth, operating while revoked (alcohol related) and five felony bail jumping charges. If convicted, he faces a maximum penalty of 10 years in prison and/or fines up to 25,000.
According to the complaint:
Pierce County deputies were dispatched at 5:52 a.m. Thursday, June 26 to a disabled vehicle stopped in the middle of the intersection at 150th Street and 330th Avenue in the town of Union. It looked like the Dodge Durango had been turning to head north when it came to a complete stop. As he approached the vehicle, the deputy saw mud and grass built up in the rear driver’s side hub cap and damage to the vehicle’s front fender.
The vehicle was still running and a man, later identified as Schultz, was sleeping in the driver’s seat. No one else was with him. When the officer knocked on the window, Schultz sat up and rolled down his window. When he stepped out of the vehicle, the officer could smell alcohol. Schultz appeared to be confused, disoriented and used the vehicle for balance. He grabbed a slice of pizza from the front passenger seat and began eating it while talking to police.
When asked why he’d stopped in the middle of the intersection, he told police he had pulled over to sleep. He said he was coming from Red Wing and had been asleep for about an hour. He denied consuming alcohol and began coughing when asked about his vehicle’s damage. Deputies didn’t locate a crash scene in the area.
Schultz refused to perform field sobriety tests or submit to a breath test. He was then handcuffed and arrested for OWI. During a vehicle search, officers located a vodka spritz and a two solo cups with unknown liquid inside.
Dispatch informed officers that Schultz’s driving status was revoked due to previous OWI convictions. He was held temporarily at Pierce County Jail until police could obtain a warrant for a blood alcohol test. Police learned Schultz had multiple open cases in Dunn and St. Croix counties for which he was out on bond with conditions of absolute sobriety. Schultz was convicted of four previous OWIs in Dunn County in 2009, 2011 and 2016, making this his fifth offense.
He is scheduled to attend a preliminary hearing in Pierce County Circuit Court at 9:30 a.m. July 24.
